Waiver of Liability

In consideration of being allowed to participate in any way in the program, related events and activities, and use of equipment, I, the participant (or parent/guardian), acknowledge, appreciate, and agree to the following:

1. The risk of injury from activities involved in this program is significant, including the potential for permanent paralysis and death.

2. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releasees or others, and accept full responsibility for my participation.

3. I agree to comply with all rules and conditions of participation. If I observe any unusual or significant hazard during my presence or participation, I will remove myself and notify a staff member immediately.

4. I understand that Brazilian Jiu-Jitsu is a close-contact activity and may expose me to known and unknown bacteria or viruses, including but not limited to COVID-19. I willingly accept and assume these risks.

5. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, and hold harmless Phenom Brazilian Jiu Jitsu Orange County LLC and TURF Fitness, including their officers, owners, staff, agents, partners, participants, sponsors, advertisers, and, if applicable, the owners and lessors of premises used to conduct the event (“releasees”), from any and all claims, demands, losses, or liability arising out of or related to any injury, disability, death, or property damage I may suffer, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law.

Health Statement

I will notify Phenom Brazilian Jiu Jitsu Orange County LLC or TURF Fitness staff if I have any medical condition that could affect my participation or require emergency care.

Media Statement

I grant Phenom Brazilian Jiu Jitsu Orange County LLC and TURF Fitness permission to record and use my (or my child’s) name, image, voice, and statements in any photo, video, or audio content for promotional, educational, or commercial purposes.

I have read this release of liability and assumption of risk agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
